THOUGHTS ABOUT THE SUPREME COURT 2ND AMENDMENT CASE

Carl F. Worden
wolfeyes@clearwire.net

The Heller Case, involving the challenge to the Washington DC handgun ban, has concerned me for several reasons.

First, my alarms went off when the Supreme Court elected to hear the case after a U.S. District Court found the handgun ban unconstitutional on 2nd Amendment grounds. The Supremes had the opportunity to simply let the ruling stand, but instead they decided to give the matter a full-court consideration. My first reaction was to question why?

Why did the Supremes choose to consider this particular gun-rights case after they refused to review the case of Michael New, who refused to obey orders to wear the United Nations uniform, an order that was clearly contrary to the oath Michael New swore when he joined the military?

The Supreme Court has also refused to review cases of civil rights abuse where so-called national security might be compromised. I have never read anywhere in the Constitution that allowed deprivation of basic constitutional rights on the basis that national security might be compromised. National security is compromised most when individual citizens’ rights are being violated, and our Constitution was written for the benefit of the individual citizen, and not for the benefit of the collective government.

So I am naturally very concerned as to the motive for this Supreme Court to hear the Heller Case.

I have this niggling suspicion the media-reported responses of the justices, who questioned the validity of the DC handgun ban during the initial arguments, were just a preliminary dog & pony show. I don’t know why, but I just have this gut-feeling.

I do know this: The DC gun ban is an outright violation of the 2nd Amendment, from its clear, original intent. Every single comment written into every record of the day by every Framer clearly indicated an intent to make certain that every citizen had the right, not only to keep, but to bear arms as well, and they also made it clear why they wanted the citizens to be armed: They intended for the citizens to have access to arms that would be necessary in order to overthrow a future U.S. Government that strayed off the constitutional reservation into tyranny.

The 2nd Amendment had nothing to do with hunting or even personal self-defense. It was put into place to keep all future U.S. Governments from stomping on the rights of the citizens, because the fathers of this nation knew human nature all too well, and they knew that a disarmed citizenry would have no course of action available to them if their own government turned against them.

So yes, I do have very grave concerns with regard to this pending Supreme Court decision. If the current justices are willing to allow cases to stand where American soldiers are given illegal orders to serve an entity separate from the United States, and if they are willing to let a sitting president declare an American citizen like Jose Padilla to be an “enemy combatant”, depriving him of all due process normally strictly enforced for all American citizens, are these same justices also willing to rule that the 2nd Amendment has limitations states can impose to ensure “public safety”?

Such a Supreme Court ruling would come in handy at a time when the United States is facing one of the worst economic shutdowns in U.S. history, with homeless and jobless American citizens living in cars and tents, unable to feed themselves or their children and willing to use violence against a government that had betrayed them. Such a ruling would deflect blame from the central government to the individual state governments and perhaps even to local governments who choose to disarm their citizens and arrest those who refuse to disarm. If you can make a criminal out of a citizen who merely possesses a gun, you can arrest that person before s/he has the opportunity to use the gun individually, and target any citizens attempting to organize resistance long before such resistance can be initiated.

The basic Bill of Rights, including the 2nd Amendment, are considered “unalienable” rights in a Constitutional Republic, which happens to be the true form of government we were gifted by the founders of this nation. These rights are not subject to change by a majority vote, such as exists in a Democracy, which is a form of government the founders of this nation had nothing but contempt for and specifically condemned.

But if the Supremes rule that individual states can enact laws that restrict or prohibit gun ownership in any way and for any reason, they will have usurped the original intent of the Framers, who specifically wrote Article X of the Bill of Rights to prevent the states from enacting such laws that infringe upon or violate our “unalienable” rights guaranteed by our Constitution.

And it wouldn’t be the first time a Supreme Court did that. Nowhere does the Bill of Rights grant free expression in addition to the right of free speech, but a Supreme Court decision perverted the original intent to include that. Nowhere does our Bill of Rights or our Constitution contain the words, “Separation between church and state”, yet if you ask most folks on the street, they wrongly believe those words do exist in the Constitution. After all, the Hugo Black Supreme Court ruled those words to be the original intent even if the Framers never intended it, and never included those words in the finished document. The liberal Hugo Black Supreme Court wanted it to be that way, so they simply ruled that way, and original intent be damned.

For me and everyone I know, anything less than a solid Supreme Court ruling that fully recognizes the right of all law-abiding citizens to keep and bear arms, will be an outright act of treason. If any allowance is made in that ruling for individual states to prohibit or strictly control guns for any reason, including public safety, the writing is on the wall and we all might as well pull together immediately, overrun Washington DC and reinstall our constitutional government by force.

The moment they come for our guns, even by a Supreme Court ruling that cracks open the door to set the stage, we either choose to fight right then while most of our military is away, or we get the hell out of Dodge. Any other choice is a bad one.

Homeschooling Is A Basic Right!

Boulder, CO - The America First Party applauds the California Court of Appeal's action to reconsider its earlier decision to ban homeschooling, and welcomes the strong showing of support from government leaders and family organizations for the homeschool movement and the fundamental right of parents to choose their children's education.

The right to homeschool touches on key values related to freedom and prosperity, including the right of the individual and family to play the legitimate role they are capable of without unnecessary interference from government. The overarching principle is of subsidiarity, which specifies that the smallest government unit should perform its proper role in society, without usurpation of that role by larger government entities. The founders implicitly respected subsidiarity in the way they designed the Constitution, and in their enactment of the Tenth Amendment, thereby limiting the role of government.

Excluding the individual, the family is the smallest government unit. Since it has the most at stake in matters relating to its own welfare, it should be allowed to perform any role related to its own welfare whenever it is capable of it. It should be obvious that the nurturing of a family's material and spiritual well-being is logically of more concern to parents than state bureaucrats, and so this should be left to parents when possible.

AFP National Chairman Jonathan Hill stated, "Parents have a right to educate their offspring so as to cultivate in them their religious and moral values. Denying this tramples on their dignity, potentially relegating them to the status of breeders of future subjects for state indoctrination and manipulation."

AFP Press Secretary Michael Lynch stated, "Why should parents be stripped of the ability to shield their children from the drugs, violence, and poor educational standards often found in public schools? If anything, we should want more homeschooling, not less."

STATEMENT FROM THE LEAGUE OF THE SOUTH ECONOMIC COMMITTEE

THE UNFOLDING FINANCIAL CRISIS

Bear Stearns: The big shark ate the little shark, and the Federal Reserve picked up the tab, fronting $30 billion to JP Morgan (big shark) to eat the little shark, AND guaranteeing the big shark it would not lose any money. It’s not plain yet how this will be shucked off onto taxpayers' backs, but it will.

Last Tuesday (11 March) the Fed announced a new "swap" facility, TALF, whereby it would take MBOs (Mortgage Backed Obligations) and other trash paper from the banks (worth maybe 15 - 20 cents on the dollar) and swap them US Treasury paper (worth 100 cents on the dollar) at even or maybe 80 cents. This bails out the banks, period, as it gives them a way to move their rotten subprime & other paper off their balance sheets and -- somehow or other -- onto the taxpayers' backs.

These Grand Larcenies are then announced as gracious, matchless benefactions to the public welfare by the felons concerned, while the same felons bask in self-congratulating applause.

The entire subprime crisis probably is a vast "pump & dump" scheme: pump up worthless paper, dump it, then profit by the short and at the bottom go long again, after a way is figured out to shift all the losses to the taxpayers' backs.

Goldman Sachs & others floated billions of dollars worth of subprime mortgage securities, with the Bush administration aiding & abetting, well-knowing these mortgages had been written to people who could NEVER fulfill them. Goldman Sachs made billions and was left with none of the worthless paper, having hawked it to suckers all over the world -- investors, pension funds, insurance companies. Perhaps they and their ilk even shorted said rotten paper as the subprime crisis exploded last June. Then they watched the crisis unfold, as the subprime paper they have shorted goes lower and lower making them more and more money. When it falls to, say 20 cents on the dollar, they reverse their position and go long, using their shills in government (remember where present Treasury Secretary Paulson and so many other recent Treasury Secretaries came from? That’s right, Goldman Sachs) to engineer a taxpayer bailout of subprime paper, which rises back to 80 cents on the dollar on strength of that bailout, and PRESTO! The crooks have made brand new fortunes, to go with their other fortunes previously extorted from investors and the market. Fed Chairman Ben Bernanke and G. W. Bush are not in charge -- they take their orders from the folks who are in charge.

The problem is that any crisis can get out of hand and take the entire earth over the edge to financial oblivion. Inertia, however, is strong.

Somehow wrapped up in all this is the obvious fact that the Powers That Be have decided to let the US Dollar drop drastically. The US Dollar Index at 70 is the first target, and then probably bleeding it as low as 40 over the coming years, letting it down slowly so the sheep won't stampede out of the dollar.

Meanwhile, gold now tops $1,000 on its way to $10,000 and silver knocks on $20 on the way to $625 -- or wherever it stops. This is why we have urged people to buy silver and gold for the last 10 years.

The crises will come faster and faster, and become worse and worse. The only way to protect yourself is to get out of debt--ALL debt; make sure you have a depression-proof way to earn a living; get some silver and gold (that is, get OUT of yankee dollars); and start rebuilding your local economies. Most of all, stay OUT of the yankee system. It is designed so that they always win and you always lose. As long as you depend on their assets -- stocks, bonds, pensions, IRAs, 401(k)s, real estate bubbles -- they own you.

Time For Resignations!

If President Nixon could be forced from Office over the coverup of an offense that was only slightly more grievous than a College prank--an illegal, undercover violation of the privacy of a political campaign office;--why should patriots not be demanding the immediate resignation of both President Bush and House Speaker Nancy Pelosi for far more serious violations of their sworn duty.

For openers, they have worked together to authorize massive intrusions into the private domains of Americans, for no better reason than they refuse to employ common sense profiling, to identify the likely objects of concern, in the "War On Terror." Rather than risk a few allegations of ethnic insult, by a finely tuned micro surveillance; we have macro intrusions into the lives of mainstream Americans, in obvious insult to the stated purposes of our written Constitution. (At the same time, they have colluded in policies, the stated purpose of which is a macro ethnic insult to hundreds of millions of people.)

During the same period, both the President and the Speaker have effectively worked together to squander 100s of billions of dollars by engaging in reckless spending, which every student of monetary theory knew in advance would have the precise effect on the value of our Dollar, that it has had. Granted, the two miscreants combined may not have the intelligence to manage a local post office in a third world nation; they have very expensive staffs--people hired precisely to provide the brain power that the "leaders" obviously lack--and there can be no conceivable excuse for the policies they have followed.

The time has come to demand resignations. Let us be among the first to do so.

International Women's Day: Code for "Advancing Radical Feminism around the Globe"

Washington, D.C. — Eagle Forum, a leading pro-family organization founded by Phyllis Schlafly, author of Feminist Fantasies, condemns the U.S. Government's endorsement of the worldwide feminist event, International Women's Day (IWD). According to its website, IWD is a "global day connecting all women around the world and inspiring them to achieve their full potential." Back in 1911, the very first IWD was celebrated in order to campaign for such noble ideals as women's right to work, to vote, and to hold public office.

Today, IWD serves to advance radical feminism in the form of promoting pro-abortion and pro-gay rights legislation, ratification of ERA, affirmative action for women, Title IX, government babysitting services, and government wage control, commonly camouflaged as "pay equity" or "comparable worth." The supporting organizations are not women's groups, but feminist groups, including Feminist Peace Network, Aurora Women's Network, UNESCO, and the United Nations Development Fund for Women, also known as UNIFEM. Even media groups, such as CNN, the BBC, and Aljazeera TV have signed on as sponsors. Tomorrow, over 450 rallies and "events" are planned in 44 different countries across the globe.

"The United States Government has no business supporting IWD," said Eagle Forum President Phyllis Schlafly. "The radical feminists know that they can't complain about American women because we are the most fortunate class of people who ever lived, so they search the globe for oppression in other countries using taxpayer dollars."

"The U.S. is joined by a crowd of sponsoring feminist groups who hide behind the guise of being the 'voice of women,' but instead promote such policies and ideals decried by the vast majority of American women, such as taxpayer-funded abortions," Schlafly said.

"These supporting organizations are the very ones who lobby for ratification of the United Nations Convention on the Elimination of All Forms of Discrimination Against Women, or CEDAW, which is basically a UN-imposed version of the Equal Rights Amendment," Schlafly said. "The U.S. Senate has yet to ratify this disastrous treaty ever since Jimmy Carter signed it in 1980, and rightly so."

"Today's feminists and CEDAW advocates view 'progress' as government-run day care, greater access to abortion, the elimination of 'Mother's Day' because it promotes an 'negative cultural stereotype,' decriminalization of prostitution in China, and government-mandated workplace benefits that men do not enjoy, just to name a few," said Schlafly. "Their goal is not equality, but preferential treatment."

"The radical feminists want to remake our laws in order to eradicate everything that is masculine from our culture and create a gender-neutral society," concluded Schlafly. "The United States should seriously reconsider lending its stamp of approval to future IWDs."

SECESSIONIST SCORES IN TEXAS PRIMARY

Larry Kilgore, a candidate for Texas Independence, scored a big count of 225,258 votes in the March 4 Texas GOP Primary. That represents 18.5 per cent of the total vote, significantly better than Ron Paul, who tallied only 1 per cent.

Eighteen per cent of the total Texas population represents 1,305,000 people, a solid hard core from which to work for a Texas secessionist movement.

Kilgore was a delegate to the Second North American Secessionist Convention in Chattanooga, TN, last October. More details on his campaign can be seen at

Let’s look at what President Bush has signed into law.

"Executive Departments and Agencies" means the executive departments enumerated in 5 U.S.C. 101, independent establishments as defined by 5 U.S.C. 104(1), Government corporations as defined by 5 U.S.C. 103(1)”. There is a distinct difference between Section 5 of the U.S. Code and what the Constitution, defines as ‘our government’.

If you think it is only the War on Terror that has caused our country to lose so many liberties and freedoms, think again. The War on Drugs is another culprit in that regards. According to the Violent Crime Control Act of 1991 the President has the power to suspend the Constitution and all rights guaranteed under it, to establish detention camps, seize your property and control populated areas in the event of a so called ‘drug crisis’.

These are the tools that have built the coffin in which lay our rights, our freedoms and our liberties as we have known them for almost 200 years under the Constitutional form of government that far too many people still believe we have. All that is left is to have the nails driven into the coffin to convert America into a police state just like Nazi Germany and Soviet Russia.

Those nails are already there, just waiting to be used, in the form of numerous Executive Orders enacted by President Bush. Here are just a few of them, with a brief synopsis of their meaning for the people of this country.

EXECUTIVE ORDER 10990 allows the government to take over all modes of transportation and control of highways and seaports.

EXECUTIVE ORDER 10995 allows the government to seize and control the communication media.

EXECUTIVE ORDER 10997 allows the government to take over all electrical power, gas, petroleum, fuels and minerals.

EXECUTIVE ORDER 10998 allows the government to take over all food resources and farms.

EXECUTIVE ORDER 11000 allows the government to mobilize civilians into work brigades under government supervision.

EXECUTIVE ORDER 11001 allows the government to take over all health, education and welfare functions.

EXECUTIVE ORDER 11002 designates the Postmaster General to operate a national registration of all persons.

EXECUTIVE ORDER 11003 allows the government to take over all airports and aircraft, including commercial aircraft.

EXECUTIVE ORDER 11004 allows the Housing and Finance Authority to relocate communities, build new housing with public funds, designate areas to be abandoned, and establish new locations for populations.

EXECUTIVE ORDER 11051 specifies the responsibility of the Office of Emergency Planning and gives authorization to put all Executive Orders into effect in times of increased international tensions and economic or financial crisis.

EXECUTIVE ORDER 11921 allows the Federal Emergency Preparedness Agency to develop plans to establish control over the mechanisms of production and distribution, of energy sources, wages, salaries, credit and the flow of money in U.S. financial institution in any undefined national emergency. It also provides that when a state of emergency is declared by the President, Congress cannot review the action for six months.

EXECUTIVE ORDER 12148 created the Federal Emergency Management Agency (FEMA) that is to interface with the Department of Defense for civil defense planning and funding. An "emergency czar" was appointed. FEMA has only spent about 6 percent of its budget on national emergencies, the bulk of their funding has been used for the construction of secret underground facilities to assure continuity of government in case of a major emergency, foreign or domestic.

EXECUTIVE ORDER 12656 appointed the National Security Council as the principal body that should consider emergency powers. This allows the government to increase domestic intelligence and surveillance of U.S. citizens and would restrict the freedom of movement within the United States and granted the government the right to isolate large groups of civilians. The National Guard could be federalized to seal all borders and take control of U.S. air space and all ports of entry. Many of the figures in the Iran-Contra scandal were part of this emergency contingent, including Marine Colonel Oliver North.

This is a lot of information to take in and the implications of it is something that needs to be pondered by all Americans who value their freedom. Has our government overstepped it’s authority? If you ask me it has gone totally off the deep end in regards to what powers it has granted unto itself. It can best be summed up by something stated by activist Howard J. Ruff, "Since the enactment of Executive Order 11490, the only thing standing between us and dictatorship is the good character of the President, and the lack of a crisis severe enough that the public would stand still for it."

One more terrorist attack, one outbreak of disease, one more major natural disaster is all that stands between our freedom and a dictatorship in which the President could suspend all Constitutional liberties and impose martial law. Is it not time to recall the words of Ben Franklin when he said, "They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety."

The choice is yours, the time is near at hand that we all must make a decision about how we wish to live, as freemen, or as slaves. I can only echo the words of Patrick Henry, “Give me liberty or give me death.”

BREAKTHEMATRIX.COM UPDATE NO. 2 - WE NEED TO BUILD COMMUNITY

We’re starting a new media company from the ground up. Impossible, you say? We don’t think so. Here’s why.

THE MESSAGE OF OUR ADVERSARIES IS WEAK

That’s right, ladies and gentlemen—their message is weak, not strong. Fox News; CNN; CBS; Rush Limbaugh; Sean Hannity; AirAmerica; Clear Channel—we have nothing to fear from these people. They are the old. They are the tired. They are the past. They are the ones with nothing to offer for the future of America. All of their billions and all of their high overhead structures are linked and tied to the failed policies of a collapsing regime. These people; these companies; the old media institutions themselves—they are on their way to the dinosaur graveyard of bad ideas. They cannot, and will not, escape their fate.

Bad ideas. The old media structure reeks with them. Bad ideas permeate everything they say; everything they do; everything they stand for. They offer war—when the American people want peace. They shill for big government—when the American people want government to get off their backs. They stand for taxes, and socialism, and a crumbling welfare state—when the people want freedom. We hear lies and propaganda every day—at a time in America when truth is desperately needed. Bad ideas, ladies and gentlemen. The reason they will fail.

OUR MESSAGE IS STRONG

Basic Media, Inc. (our new company in formation) will deliver and carry a fundamentally different message to the American people. Our media content will offer a new set of values, and a fresh philosophy of hope and optimism. These will be our central points:

End our overseas empire; and bring the troops home.

End the Federal Reserve; break the debt money culture and the stranglehold of our bankers.

Limit our central government to its proper Constitutional framework; end the income tax (and so much more).

Dismantle the police state; and free the American people.

This, of course, is the very message that our old media icons seek to stifle, and ignore, and marginalize, and ridicule. The old media people loathe and despise these simple values, and the reason for their hatred is obvious, isn’t it? They hate our message BECAUSE it is strong. They stifle our message because they KNOW we’ll succeed if the American people hear our words. They hide the truth because truth exposes their lies. It’s no more complicated than that.

WE NEED TO BUILD COMMUNITY

The essential first step is clear and obvious. We need to build community. Individuals acting alone cannot achieve a lasting success. Donations to the cause; volunteerism; good intentions—these things are immensely valuable, but they are not enough. We have to DO SOMETHING MORE. We have to FIND EACH OTHER, AND ACT TOGETHER. Our adversaries want to keep us separated, and divided, and apart. They want to keep us weak, and controlled, and silenced. They don’t want us to join together; to move in unison; to be like they are. Keeping us apart is the key to their power, ladies and gentlemen. They have community. And so must we.

Our community will start right here on the Internet. We’ll begin with the development of interesting and entertaining content for online radio and television, and the creation of a community web portal where our supporters can gather and find each other. Then we grow from there. We’ll start out small, with the sharing of voices and faces online. People talking, and spreading the words of freedom. When the time comes we’ll move off the Internet to terrestrial radio stations and television outlets across America. It won’t happen quickly. It won’t be easy. We should not kid ourselves—this effort will take time, and money, and energy, and vision. But it can be done, and it’s going to happen because it MUST happen. It’s going to happen because the time has come for the plundering of America to stop.

Building community—that’s what matters most, and that’s what we’re looking to achieve. Our financing tool is simple. We’re going to proceed with a public offering of stock through the Internet. Nothing quite like this has ever been done before, but something new is needed. So the day is coming when we’ll be asking you to invest in our vision. The choice will be yours to make.

That’s what’s we’re planning, but for now we ask only that you read and consider our written messages at breakthematrix.com. If you think we’re on the right track, click the pledge button. Show your support, and spread the word. Tell your friends, your family, your colleagues, and move the idea forward. The creation of our community has already begun, but we need to see it grow if we are going to truly have an impact in getting the word out to the American people. To our more than 5200 subscribers who’ve pledged so far, we say: THANK YOU. To those of you who are learning about us for the first time, we say: check it out. There will be much more to follow in upcoming weeks and months as we get things moving. It’s a process, one small step at a time, and this is merely the initial and non—binding “solicitation of interest” stage. We invite you in; the water’s fine. Tell us now if you’re interested; a detailed Offering Circular will follow later when the newly forming company is up and ready. In the meantime, here are the applicable Securities and Exchange Commission rules for where we are today:

No money or other consideration is being solicited by this document, and if sent in response, will not be accepted;

No sales of securities will be made or commitment to purchase accepted until delivery of an offering circular that includes complete information about the issuer and the offering;

An indication of interest by a prospective investor involves no obligation or commitment of any kind.

As is our custom here at breakthematrix.com, we close with some words of Ron Paul from the presidential campaign trail. Dr. Paul says: “How can we ask one young American to die for a neocon empire?” How, indeed.
